Terms and Conditions – Alicja Korbinska Photography
Definitions
Photographer: Alicja Korbinska Photography
Client: The individual, company, or organisation commissioning the Photographer’s services.
Images: All photographs, digital files, video clips, reels, or other visual content created by the Photographer.
Booking and Payment
Booking Confirmation
A booking is confirmed upon written acceptance of the quotation and receipt of a non-refundable booking fee equal to 50% of the quoted project fee.The booking fee secures the agreed shoot date and is deductible from the final invoice total.Dates are not reserved until the booking fee has been received in full.
Final Payment
The remaining balance is due prior to delivery of final high-resolution Images unless otherwise agreed in writing.The Photographer reserves the right to withhold delivery of final Images until full payment has been received.Late payments may incur interest at 4% per month above the Bank of England base rate, together with any reasonable recovery costs.
Cancellation and Rescheduling
Client Cancellation
The booking fee is non-refundable.Rescheduling requests made more than 48 hours prior to the scheduled shoot date may be accommodated once without penalty, subject to availability.Repeated rescheduling requests or cancellations within 48 hours of the shoot may result in additional charges.If the Client cancels the project entirely, any completed work, preparation time, travel costs, or production expenses incurred up to that point will remain payable.
Photographer Cancellation
In the unlikely event that the Photographer is unable to fulfil the booking due to illness, emergency, or circumstances beyond reasonable control, all reasonable efforts will be made to reschedule the session.If rescheduling is not possible, any fees paid will be refunded in full. The Photographer’s liability shall be limited to the total amount paid by the Client.
Scope of Work and Additional Requests
Quotations are based on the agreed scope of work, including shoot duration, number of spaces, deliverables, and intended usage discussed prior to booking.Additional requests made during or after the shoot — including but not limited to additional rooms, spaces, products, extended coverage, extra revisions, return visits, or additional deliverables — may incur additional fees.Any overtime caused by delays outside the Photographer’s control may be charged accordingly.
Copyright and Licensing
Copyright Ownership
The Photographer retains full copyright and ownership of all Images produced.No copyright is transferred to the Client unless explicitly agreed in writing.
Usage Licence
Upon full payment, the Client is granted a non-exclusive, non-transferable licence to use the final delivered Images for the agreed business, editorial, marketing, website, social media, PR, and promotional purposes discussed at the time of booking.Specific licensing terms may vary depending on project scope and intended usage.Any usage outside the agreed terms requires prior written permission from the Photographer.
Third-Party Usage
The licence granted applies solely to the named Client.Third-party usage — including but not limited to contractors, architects, interior designers, developers, suppliers, furniture companies, staging companies, publications, or collaborating businesses — requires separate written permission or licensing agreement unless otherwise agreed in writing prior to delivery.
Credit and Attribution
Where reasonably possible, the Client agrees to credit the Photographer as:“Alicja Korbinska Photography”and include a link to the Photographer’s website:www.alicjakorbinska.comparticularly for editorial features, PR publications, online articles, and social media usage.
Portfolio and Self-Promotion
The Photographer reserves the right to use the Images for portfolio purposes, website display, social media, awards, exhibitions, competitions, publications, marketing, and self-promotional use unless otherwise agreed in writing prior to the shoot.
Creative Approach and Editing
The Client acknowledges familiarity with the Photographer’s portfolio, style, and creative approach.The Photographer retains full creative control over composition, lighting, editing style, image selection, and post-production interpretation.Final delivered Images are selected and edited at the Photographer’s professional discretion.Requests for substantial re-editing, compositing changes, object removals, or stylistic alterations beyond the Photographer’s standard workflow may incur additional fees.
RAW Files and Unedited Material
RAW files, unedited Images, and original production files are not included and remain the property of the Photographer unless otherwise agreed in writing.Any release of unedited material is entirely at the Photographer’s discretion and may require additional licensing fees.
Image Delivery
Final edited Images will typically be delivered within 14 business days unless otherwise agreed depending on project size and production requirements.For larger commercial, editorial, or multi-party projects, delivery timelines may vary and will be communicated accordingly.Proof galleries may be provided for image selection purposes.
Proof Gallery Usage
Proof galleries are intended solely for review and image selection.Downloading, screenshotting, screen recording, sharing, or otherwise reproducing Images from proof galleries without written permission is strictly prohibited and constitutes copyright infringement.The Photographer is not responsible for any unauthorised use of preview Images by third parties.
Image Storage and Archiving
Final edited Images will be archived for approximately 6 months following delivery.While reasonable care is taken with digital storage, the Photographer does not guarantee indefinite archiving.Requests for re-sending archived Images may incur an administrative fee.The Client is responsible for maintaining their own backups after delivery.
Property Readiness and Styling
The Client is responsible for ensuring the property is fully prepared, cleaned, styled, and accessible prior to the Photographer’s arrival.The Photographer is not responsible for compromised results caused by incomplete styling, unfinished construction, inaccessible spaces, delays by third parties, weather conditions, or site readiness issues.If additional visits are required due to incomplete preparation, additional fees may apply.
Travel and Expenses
Travel within agreed local areas is included unless otherwise stated.Projects requiring additional travel, accommodation, parking, congestion charges, flights, or other transport expenses will be quoted separately or invoiced accordingly.
Weather Dependency
Exterior photography and natural light conditions are weather dependent.The Photographer reserves the right to recommend rescheduling exterior portions of a shoot where weather conditions materially affect achievable results.
Liability
The Photographer shall not be liable for indirect, consequential, or business losses arising from the use or inability to use the Images.In all circumstances, liability shall be limited to the total amount paid by the Client for the relevant services.
Force Majeure
The Photographer shall not be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to illness, accidents, equipment failure, transport disruption, extreme weather, acts of God, strikes, government restrictions, or emergencies.
Governing Law
These Terms and Conditions are governed by the laws of England and Wales.Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Agreement
By confirming a booking and/or engaging the Photographer’s services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
