Terms and Conditions for Interior Architecture Photography Services

  1. Definitions

    Photographer: Alicja Korbinska Photography, provides interior architecture and personal branding photography services.

    Client: The individual or entity engaging the Photographer's services.

    Images: All photographs, digital files, or other visual representations produced by the Photographer.

  2. Booking and Payment

    Confirmation: A booking is confirmed upon receipt of a signed agreement and payment of a non-refundable booking fee equivalent to 50% of the primary quoted price. This booking fee is deductible from the total invoice amount. Payment of the full booking fee is required to secure and confirm the date. Bookings are not solid until the full deposit is paid, and dates cannot be held without it.

    Balance Payment: The remaining fee is due upon final image delivery, unless alternative arrangements have been agreed upon in writing.

  3. Cancellation and Rescheduling

    Client Cancellation: If the Client cancels the booking within 48 hours of the scheduled session, the deposit will be forfeited. Cancellations made prior to this period may be rescheduled free of charge if done before 48 hours prior to the photoshoot, subject to the Photographer's availability.

    Photographer Cancellation: In the unlikely event that the Photographer must cancel, any fees paid will be refunded in full, and reasonable efforts will be made to reschedule the session.

  4. Copyright, Usage Rights, and Credit

    Ownership: The Photographer retains full copyright of all Images produced.

    License: Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the Images for purposes agreed upon in writing, such as marketing, portfolio, or editorial use. Any other usage requires prior written consent from the Photographer.

    Credit and Attribution: When Images are used in printed PR publications, website uploads, or uploaded to third-party promotional materials or websites, the Client agrees to credit the Photographer as the rightful owner:
    “Alicja Korbinska Photography”, and where possible include a link to the Photographer’s website: www.alicjakorbinska.com.

    Photographer's Portfolio and Publications: The Photographer reserves the right to use the Images for self-promotion, including but not limited to portfolio display, website content, social media, and industry publications, unless otherwise agreed upon in writing with the Client.

  5. Image Delivery and Alterations

    Delivery: Final edited Images will be delivered within 14 business days of the session unless otherwise specified. For branded photoshoots, a proof gallery will be provided for selection prior to final edits.

    Alterations: The Client may crop or add text to the Images as needed. However, any other modifications, such as applying filters or altering the original content, require the Photographer's written permission.

  6. Model and Property Releases

    Client Responsibility: The Client is responsible for obtaining all necessary permissions, including model and property releases, for the use of the Images. The Photographer is not liable for any claims arising from the lack of such permissions.

  7. Liability

    Limitation: The Photographer is not liable for any indirect or consequential losses arising from the use of the Images. In any event, the Photographer's liability shall not exceed the total amount paid by the Client for the services rendered.

  8. Confidentiality

    Client Information: The Photographer agrees to keep confidential all information and materials provided by the Client unless required by law or with the Client's consent.

  9. Image Storage and Archiving

    Archiving: The Photographer will keep final edited images archived for a period of time (typically 6-12 months). After this period, images may be deleted without notice. Retrieval or re-upload of archived images after delivery may incur an administrative fee. Starting rates for this are available upon request, with exact quotes provided after assignment briefing.

  10. Site Access and Safety

    Access and Safety: The Client is responsible for ensuring safe, unobstructed access to the property and that it is ready for photography at the agreed time. The Photographer reserves the right to refuse to photograph areas deemed unsafe or unfinished.

  11. Styling and Property Readiness

    Property Readiness: The Client is responsible for ensuring the property is clean, tidy, and styled as desired prior to the Photographer's arrival. Additional time spent waiting for preparation or styling will be charged at an hourly rate. Starting rates are available upon request, with exact quotes evaluated after assignment discovery.

  12. Additional Editing Requests

    Retouching: The quoted fee includes standard editing (lighting, colour correction, perspective correction). Additional retouching or image manipulation (e.g. object removal, heavy edits) is chargeable at an hourly rate. Starting rates are available upon request, with exact quotes evaluated after briefing on specific editing needs.

  13. Travel Costs

    Travel: Travel within agreed local areas is included. Travel outside these areas will be charged at a mileage rate or reimbursed based on transport costs (e.g. train, flight), depending on assignment location. Starting travel rates are available upon request, with exact quotes evaluated after assignment details are confirmed.

  14. Weather Dependency (Exterior Shoots)

    Weather Conditions: For exterior shoots, the Photographer is not liable for adverse weather conditions. Rescheduling due to poor weather is subject to availability and may incur additional costs if rescheduled within 48 hours of the shoot.

  15. Force Majeure

    Force Majeure: The Photographer is not liable for failure to perform services due to unforeseen circumstances beyond reasonable control, including but not limited to illness, accidents, travel delays, extreme weather, or acts of God.

  16. Governing Law

    Jurisdiction: These terms and conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  17. Agreement

    Acceptance: By engaging the Photographer's services, the Client acknowledges that they have read, understood, and agree to these terms and conditions.
